Regulations (Definitions)
Under the Educator Discipline Act (24 P.S. §§2070.1 et seq. ), the Commission is vested with the power to discipline educators, which includes public and private certificated educators, charter and cyber charter school staff members and contracted educational provider staff members. In
Chapter 237, Title 22 of the Pennsylvania Code, the Commission adopted regulations defining terms found in section 5 of the Act. The terms defined include: immorality, incompetency, intemperance, cruelty, negligence and moral turpitude. 22 Pa. Code §237. These definitions, in addition to judicial and Commission interpretations thereof, guide the Commission in its decision-making.
